The brand new Archbishop of San Francisco, Salvatore Cordileone, has been arrested for drunk driving. Cordileone is widely considered the “father of Proposition 8.”

Police in San Diego say Bishop Salvatore Cordileone was arrested over the weekend for driving under the influence. Police say it happened in San Diego’s College District just before 12:30 Saturday morning. Bishop Cordileone is currently bishop of Oakland — a post he’s held since 2009. Last month Pope Benedict chose Bishop Cordileone to become archbishop of San Francisco — replacing retiring Archbishop George Niederaur. He’s scheduled to assume the new post in October.

Anti-Gay Activist and Proposition 8 Supporter/Donor Charged with Molesting Boys on Church Outings

A longtime anti-gay activist, California Prop 8 donor,  and  elementary school teacher was taken into custody on August 17th after admitting inappropriate contact with young boys.Caleb Douglas Hesse, a teacher for the Morongo Unified School District since 1987 (most recently, he was teaching first grade at Friendly Hills Elementary School in Joshua Tree) and a longtime youth volunteer with the virulently homophobic Evangelical Free Church of Yucca Valley, has  confessed to sexually abusing “numerous underage boys,” with authorities believe the crimes occurred between the early 1980’s and as recently as a week ago.”
Investigators say Hesse met the majority of the victims during overnight outings with a youth group at the Evangelical Free Church
During his arraignment on August 21st Hess recanted his confession and changed his plea to “not guilty”.
Hess’s bail was set at 2,5 million dollars.

Ninth Circuit Denies En Banc Rehearing of Proposition 8 Appeal Ruling

In Victory For Marriage Equality, Appeals Court Declines To Reconsider Proposition 8 Case | The U.S. Court of Appeals for the Ninth Circuit today decided not to re-hear the case for Proposition 8, California’s ban on marriage equality. A three-judge panel previously found the amendment unconstitutional, but lawyers asked for a trial by a larger 11 judges panel. Since those judges have now decided not to hear the case, its next logical step is the Supreme Court.

It’s worth noting that only 4 of the Ninth Circuit’s 27 active judges indicated that they wanted this case to be reheard. Three of those judges, Diarmuid O’Scannlain, Jay Bybee and Carlos Bea joined a dissent from the denial of rehearing which cited President Obama to claim that marriage discrimination should remain the law in California:

A few weeks ago, subsequent to oral argument in this case, the President of the United States ignited a media firestorm by announcing that he supports same sex marriage as a policy matter. Drawing less attention, however, were his comments that the Constitution left this matter to the States and that “one of the things that [he]’d like to see is–that [the] conversation continue in a respectful way.”

Rob Reiner: Champion of Equal Rights!

I have liked Rob Reiner ever since he came on to the little screen as Michael “Meathead” Stivik on the CBS sitcom “All in the Family”. He portrayed an ultra-liberal “hippie”-type who married the quintessential white bigot’s daughter. He has since become among other things a huge supporter of marriage equality for the Gay and Lesbian community. I saw him on “Morning Joe” yesterday and he was talking about his support for marriage equality and “8”, the play by Dustin Lance Black about the Proposition 8 legal proceedings in California. Rob should be celebrated not only for his role in this project but for his work as a founding member and Board member of American Foundation for Equal Rights.

Proposition 8 Appeal is today!

The Ninth Circuit Court of Appeals is hearing oral arguments today on Proposition 8, the California Proposition that outlawed same-sex marriage in California. You may remember that on Aug. 4, U.S. District Court Judge Vaughn Walker held that Proposition 8 violated the federal constitutional guarantees of equal protection of the laws and due process of law, which protects “fundamental” rights — including marriage.
The oral arguments before the Ninth Circuit are being telecast on C-Span at 1PM EST. This is our government in action folks, deciding on the constitutionality of denying rights to a minority. You may not think that this will be riveting TV but I can assure you that nothing (with the exception of Neil Armstrong’s moon walk or Krystle Carrington giving Alexis Colby a bitch-slap in the koi pond) could be of more interest to me. Olsen and Boies to Prop 8: You’re probably going to have to pay

Attorneys representing two California gay couples in the federal Proposition 8 case may seek to recoup mounting legal fees from their opponents if an appeals court upholds U.S. district judge Vaughn Walker’s landmark decision. 
In court filings this week, the attorneys requested extended time to consider fees and court costs but have also asked Prop. 8 supporters for an expedited response in the matter — which they opposed in a Wednesday filing.
“Plaintiffs seek to drastically shorten [our] time to respond to that motion so that they have more time to prepare an application for attorney’s fees in the event this Court does not grant their motion to enlarge time,” Alliance Defense Fund attorney Brian Raum wrote. “Such a burden shift is unwarranted.” 
The legal team led by Ted Olson and David Boies has not disclosed how much the litigation has cost, though the organization charged with funding the suit, the American Foundation for Equal Rights, has in recent weeks reached out to the public for donations as the case proceeds to the U.S. court of appeals for the ninth circuit. 
Oral arguments are scheduled for the week of December 6.
Good! They should pay up.  This case is simple. Can the majority deny rights to a group of American citizens because they think we are inferior? The (according to Conservatives, Holy-of-Holies) US Constitution says: No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

When all else fails demonize the Gays

GOP gubernatorial candidate Meg Whitman said that, unlike Governor Arnold Schwarzenegger or Attorney General Brown who have declined defending the measure, she would defend Proposition 8 if elected governor:
“The issue right now is, as I understand is ‘Will Proposition 8 have the appropriate support to actually make an appeal to the circuit court of appeals?’ ” Whitman said. “And I think the governor, the attorney general today has to defend the constitution and has to enable the judicial process to go along and has to enable an appeal to go through. So if I was governor, I would give that ruling standing to be able to appeal to the circuit court.” 
The Courage Campaign took Whitman’s hypothetical situation and threw it in the trash.
“She wouldn’t be governor yet. The appeals court will decide before there would be a change of governor and attorney general…You’re going to see us making it clear that Meg Whitman is unqualified to be governor on any stand.”
So what’s happening here is Whitman burnishing her “cred” with the homophobe creatures in California by letting them know that “if I could” I would keep the gays from marrying. ItThat’s  like me saying that “I would free all political prisoners in Myanmar” if elected to the presidency of Myanmar. No chance of that happening soon I think.

Judge Walker is expected to rule in Perry v. Schwarzenegger in a few weeks, and the case is expected to be appealed to the Supreme Court.
Reuters reports on the defense’s stunning statement that they did not need any evidence to prove the purpose of marriage:

Coop Conservative Charles Cooper led the defense, arguing that it is reasonable to fear that allowing same-sex marriage would undermine heterosexual marriage and self-evident that the purpose of marriage was procreating and raising children.

You don’t have to have evidence” to prove that the purpose of marriage is to bear and raise children, he said in the closing arguments, citing legal precedents.
Months earlier, he had surprised the court by saying he did not know how gay marriage would hurt heterosexuals — and that he did not need to know in order to win the case.

“At the end of the day, ‘I don’t know’ and ‘I don’t have to present any evidence,’ with all respect to Mr. Cooper, doesn’t cut it,” responded Olson on Wednesday. Walker subjected Cooper to a barrage of questions, turning the lawyer’s closing arguments into a cross-examination about the purpose of marriage, the state’s role, and whether gays deserve special court protection akin to racial minorities. Cooper contended that the only way to invalidate Prop 8 was to prove there had been absolutely no good reason, or rational basis, for millions of Californians to back it.

NOM’s Maggie Gallagher basically conceded the trial in a statement late yesterday:
“Chuck Cooper is a heckuva lawyer. At stake in this case is the future of marriage in all 50 states, and he’s right that this attempt to shut down the debate by constitutionalizing gay marriage will backfire. Americans have a right to vote for marriage. Ted Olson doesn’t seem to understand the argument, and judging from today’s exchanges neither does Judge Walker. I expect Judge Walker will overrule Prop 8. But millions of Americans do understand why marriage is the union of husband and wife and I believe the majority of the Supreme Court will as well.”
